Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Revival Solar LLC (“Revival Solar,” “we,” “us”) that govern your use of the Revival Solar Customer Portal website and mobile app (together, the “Service”).

Please read these Terms carefully. They include a limit on our liability (Section 15), an indemnification obligation that requires you to cover certain claims (Section 16), and an agreement that Oregon law applies and that disputes are heard in Jackson County, Oregon (Section 17).

1. Accepting these Terms

You accept these Terms by checking the acceptance box when you set up your account, or by continuing to use the Service after we ask you to accept an updated version. If you do not agree, do not use the Service. We keep a record of the date, time, and version you accepted.

2. The Service

The Service lets you connect a supported solar monitoring platform to your Revival Solar account so you can view production, receive alerts and reports, manage your service plan, and submit support requests. It is a convenience tool to help you stay informed about your solar system. It is not a substitute for the manufacturer’s monitoring, your installer’s warranty, or professional inspection, and it is not a life-safety, emergency, or alarm system.

3. Who can use the Service

You must be at least 18 years old and able to enter into a binding contract. You may only connect a solar system that you own, lease, or are otherwise authorized to monitor. You agree to provide accurate information and to keep it up to date. You are responsible for everything that happens under your account, so keep your login credentials confidential and tell us promptly if you believe your account has been used without your permission.

4. Your monitoring platform connection

To show your production we need access to your solar monitoring account. By connecting a platform you represent that you are authorized to grant that access, and you authorize Revival Solar to retrieve data from that platform on your behalf using the credentials or authorization you provide. You may disconnect any platform at any time from the dashboard. Stored monitoring credentials are encrypted at rest, as described in our Privacy Policy.

Your relationship with each monitoring platform is governed by that platform’s own terms and privacy policy, not by these Terms. A platform may change or withdraw its access at any time, and if it does, the corresponding features of the Service will stop working. We are not responsible for the acts, omissions, availability, accuracy, or pricing of any third-party platform.

5. Plans, billing, and cancellation

  • Free plan. The free plan is offered at no cost and may be changed or discontinued at any time.
  • Paid plans. Paid plans are billed monthly or annually through Stripe at the price shown when you subscribe. Subscriptions renew automatically at the end of each billing period until you cancel. You authorize us to charge your payment method on each renewal.
  • Taxes. Prices do not include taxes, which may be added where required.
  • Cancellation. You can cancel any time from the billing section of the portal. Cancellation takes effect at the end of the current billing period; we do not provide prorated refunds for partial periods, except where required by law. Deleting your account cancels any paid plan immediately, also with no prorated refund.
  • Failed payments. If a payment fails, we may retry it and may suspend or downgrade paid features until the balance is settled.
  • Price changes. We may change prices for future billing periods. We will give you reasonable advance notice by email, and the change will apply on your next renewal.

Your portal subscription is separate from any Care Plan, warranty, installation contract, or service agreement you hold with Revival Solar directly. Canceling one does not cancel the other.

6. Alerts, reports, and monitoring — important

The Service depends on third-party monitoring platforms (such as Hoymiles, APsystems, Tesla, SolarEdge, Enphase, SMA, Generac, Fronius, and FranklinWH), internet connectivity, email and push notification providers, and other systems we do not control. Alerts and reports may be delayed, missed, incorrect, or not delivered at all because of outages, API changes, account problems on the monitoring platform, your device settings, or other reasons.

Alerts and reports are informational only. They are not a guarantee that your solar system is working, and the absence of an alert is not a guarantee that nothing is wrong. You remain responsible for monitoring your own system, maintaining your equipment, and following the warranty and maintenance requirements of your installer and equipment manufacturers.

7. Acceptable use

You agree not to:

  • Use the Service for anything illegal, harmful, or fraudulent.
  • Connect a monitoring account that you are not authorized to access.
  • Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service.
  • Reverse engineer, copy, scrape, or resell the Service.
  • Share your account with another person or impersonate someone else.
  • Upload content that is harassing, defamatory, or infringes anyone’s rights.
  • Use the Service to build a competing product or to train a machine-learning model.

We may suspend or terminate your account if we reasonably believe you have violated these Terms.

8. Your content and feedback

You keep ownership of the information you submit, including support requests and system details. You grant us a non-exclusive, worldwide, royalty-free license to host, store, and use that information as needed to operate, support, secure, and improve the Service. If you send us suggestions or feedback, we may use them freely without any obligation to you.

9. Intellectual property

The Service, including its software, design, text, graphics, and the Revival Solar name and logo, belongs to Revival Solar and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal or internal business purpose.

10. Mobile app and app stores

If you download the Revival Solar mobile app, you also agree to any rules of the Apple App Store or Google Play that apply to apps you install through them. Paid plans and billing are managed from the portal website, not through in-app purchase.

Apple-specific terms. These Terms are between you and Revival Solar only, not Apple, and Apple is not responsible for the app or its content. Your license to use the iOS app is limited to Apple-branded devices you own or control, as permitted by the App Store Usage Rules. Revival Solar, not Apple, is solely responsible for the app, for any maintenance and support, for any product warranties, for addressing any claim that the app or your use of it fails to conform to a legal requirement or infringes a third party’s intellectual property rights, and for handling any product liability or consumer protection claim relating to the app. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Electronic communications

By creating an account you consent to receive communications from us electronically, including service and account notices, alerts, and reports, at the email address on your account. You can turn off push notifications in your device settings and unsubscribe from non-essential email, but we may still send you notices required to operate your account. Any text messages we send are service messages related to your account or a job in progress, not marketing, and standard message and data rates may apply.

12. Deleting your account and your data

You can delete your account yourself at any time. Sign in and go to Account → Delete account in the portal or the mobile app, type the confirmation, and confirm. If you can’t sign in, email Help@SolarRevival.com from your account email address or call (541) 500-6260, and we will complete the deletion within 30 days. See Delete Your Account for step-by-step instructions.

Deletion is permanent and immediate. When you delete your account we remove:

  • Your profile: name, email address, phone number, and service address.
  • Every solar monitoring connection and the stored credentials for it.
  • The production history, snapshots, and alert history for your connected system.
  • Your support requests submitted through “Report an Issue.”
  • Any mobile push-notification tokens for your devices.
  • Your login identity with our authentication provider, so you can no longer sign in.

Deleting your account cancels any paid portal plan immediately, with no prorated refund for the remainder of the current period. We retain billing and transaction records (such as invoices and payment history) for as long as tax, accounting, and other law requires, after which they are deleted, and we may retain records we need to resolve a dispute or enforce these Terms. Backups are overwritten on a rolling basis and any residual copies are purged within 90 days. Deleting your portal account does not delete your account with your solar manufacturer, and it does not cancel a Care Plan, warranty, or service agreement you hold with Revival Solar directly. Our Privacy Policy describes your other data rights, including access and correction.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate the Service or your account if you violate these Terms, if we are required to by law, if your account creates a security or legal risk, or if we discontinue the Service. If we discontinue the Service entirely, we will give you reasonable advance notice and refund the unused portion of any prepaid annual plan. Sections that by their nature should survive termination will survive, including Sections 8, 9, 14, 15, 16, 17, and 19.

14. Disclaimers

The Service is provided “as is” and “as available.” To the fullest extent allowed by law, Revival Solar disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that production data, alerts, or reports will be accurate, complete, or delivered.

The Service does not replace any warranty, service contract, or maintenance agreement you have with your installer, equipment manufacturer, or any third party.

15. Limitation of liability

To the fullest extent allowed by law, Revival Solar and its owners, members, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, energy production, expected savings, utility credits, data, or goodwill, or for equipment damage or repair costs arising from an alert that was delayed, missed, or inaccurate — even if we have been advised of the possibility of those damages, and regardless of the legal theory the claim is based on.

Liability cap. Our total aggregate liability for all claims relating to the Service is limited to the greater of (a) the total amount you paid Revival Solar for the Service in the twelve months immediately before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

This limit applies to all claims in the aggregate, not to each claim separately, and applies even if a limited remedy is found to have failed its essential purpose. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, personal injury caused by our negligence, or a party’s willful misconduct. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of Sections 14 and 15 may not apply to you, and nothing here is intended to limit your rights under the Oregon Unlawful Trade Practices Act.

This section limits liability for the portal Service only. It does not limit our obligations under a separate installation contract, Care Plan, warranty, or service agreement you hold with Revival Solar, which are governed by their own terms.

16. Indemnification

You agree to defend, indemnify, and hold harmless Revival Solar and its owners, members, employees, contractors, and agents from and against any third-party claims, demands, suits, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or related to:

  • your use or misuse of the Service;
  • your violation of these Terms;
  • your connection of a monitoring account you were not authorized to access, or your breach of a third-party platform’s terms;
  • content or information you submit through the Service; or
  • your violation of any law or the rights of any third party.

We will notify you of any claim we seek indemnification for and may, at our option, control the defense and settlement of that claim with counsel of our choosing at your expense. You agree to cooperate reasonably in the defense, and you may not settle any claim in a way that imposes an obligation or admission on us without our prior written consent. This obligation survives termination of your account.

17. Governing law and disputes

These Terms and any dispute arising out of them or the Service are governed by the laws of the State of Oregon, without regard to its conflict of laws rules. The U.N. Convention on Contracts for the International Sale of Goods does not apply.

Before filing anything, you and Revival Solar agree to try in good faith to resolve the dispute informally by contacting the other in writing and allowing 30 days to work it out. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Jackson County, Oregon, and you and Revival Solar each consent to personal jurisdiction and venue in those courts and waive any objection based on inconvenient forum. Nothing in these Terms prevents either party from bringing a qualifying claim in small claims court, or from seeking injunctive relief to protect intellectual property or account security. Any claim must be brought within one year after it arises, or it is permanently barred, except where a longer period is required by law.

18. Changes to the Service or these Terms

We may change, add, or remove features of the Service at any time. We may also update these Terms. When we do, we will revise the “Last updated” date and version number above. For material changes, we will ask you to review and accept the updated Terms the next time you open the portal or the app, and we will give you reasonable notice by email. If you do not accept, you can stop using the Service and delete your account under Section 12.

19. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Revival Solar about the Service and supersede any prior understanding about it.
  • No waiver. Our failure to enforce any part of these Terms is not a waiver of our right to enforce it later.
  • Severability. If any part of these Terms is held unenforceable, it will be modified to the minimum extent necessary and the rest will remain in effect.
  • Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of all or substantially all of our assets.
  • Force majeure. Neither party is liable for a delay or failure caused by something outside its reasonable control, including utility or internet outages, third-party platform failures, natural disasters, wildfire, labor disputes, or government action.
  • Notices. We give notice by email to the address on your account or by posting in the Service. You give notice to us at Help@SolarRevival.com.
  • Relationship. These Terms do not create a partnership, joint venture, employment, or agency relationship between you and Revival Solar.
